ABA joins legal condemnation of PM

The Australian Bar Association (ABA) has criticised prime minister Tony Abbott for his attack on Gillian Triggs.

ABA president Mark Livesey QC said criticisms of independent courts, tribunals and commissions undermine the rule of law in Australia.

"Real care must be taken to maintain respect for the institutions charged with the responsibility of applying the law and deciding cases,"said Livesey, who noted that this worrying trend was not recent. "The previous government's criticism of the High Court over its immigration decision a few years ago is another example.

"This must stop. Politicians must guard against criticising decision-making simply because they don’t like the decision, and personal attacks on judges or commissioners is never appropriate."

Abbott’s (pictured) recent comments that Human Rights Commission president Gillian Triggs demonstrated “extremely questionable judgement” have drawn the ire of the legal community.

Abbott’s comments were in relation to Trigg’s determination that convicted refugee John Basikbasik’s human rights had been violated under the International Covenant on Civil and Political Rights by being held in detention for almost seven years after completing his prison sentence.

Triggs recommended that Basikbasik be paid $350,000 in compensation.

“The Human Rights Commission does have an important role to play, but decisions like this do tend to shake people's confidence,” said Abbott.

The ABA said a court or commission does not “decide how odious or worthy a person is”.

“The proper role of any court, tribunal or commission is to apply the law objectively and impartially,” said Livesey.

The Human Rights Law Centre and former Australian Lawyers Alliance president Greg Barns have also questioned Abbott’s comments.

Barns has linked the PM’s attack to the imminent release of children in immigration detention.

“I would be stunned if Dr Triggs’ report was anything other than, not just embarrassing, but shattering to a country which purports to uphold the rule of law, fairness and says it’s about subscribing to human rights protocols,” he told Lawyers Weekly.

    <p>I completely agree with you. Her position is untenable and she should go. The sooner the better. The HRC should be disbanded. It is a serious waste of tax payers money.</p>

    <p>aah, Gillian Triggs; lectured the minister that christmas island detention had armed guards, then when she was flatly contradicted on this point she said 'I'm a lawyer' and then 'lets move on to something else' because she knew she was wrong. See the video yourself:<a href="" rel="nofollow">www.youtube.com/watch?...</a></p><p>She recommended the Australian govt pay 300k+ to an asylum seeker who battered his partner to death.</p><p>Waited until after Labor left power to instigate a 'inquiry' into children in detention ; when the numbers had already halved.</p><p>Of course, anyone who criticizes Gillian for the above is automatically a sexist displaying misogyny; she can do no wrong.</p>

It is about interpretation of our standing laws and international obligations, which are what define a civil society, that is not 'leftie', it is actually, and unarguably, the core premise of western civilisation and always has been.<br>Troll on, Abbott apologist.</p>

    <p>Has the ABA has suddenly become a "leftie" org ? I can think of a few places where courts and tribunals are free of criticism. Start with North Korea. After attending a jurisprudence seminar at UoS Law School last year I went I search of Grigg's book on International law. Only had time to look at the last chapter. After a lifetime of guessing at what people rally mean when preparing for a cross-examination I would say that the author's real position is that the UN is a proto-type world government and that treaties trump even the Constitution. TA has a tin ear. Our old soldiers deserved the French Republic's Legion of Honour. Both the Queen and Philip Mountbatten served personally in WWII. TA did not give the AK to the Emperor of Japan. We should have something to give friends like Indonesian President Yudioyno (if that is how you spell it) and people like that. All the retentives can stay that way. We are an Anglophone country at the bottom of the world and we need all the connections to Europe and the anglosphere we can get. Trade with China does not mean we have to like their dictatorship but we do not have to spit at them every time there is a conference. The 60% closure rule means that the US is a very limited democracy which elects an early 18th century king every 4 years. Just like Alabama. But that is no reason to spit at them either. TA,s tin ear seems to mean that he cannot get our country moving because he can not employ his troops well. Barnaby Joyce should be made a Special Minister of State to negotiate with the entertaining oddballs in the Senate. If Griggs was serious she should be looking into how to stop the economic illegal migrants and how to double or treble our intake from our intake from the refugee camps. They are the poorest of the poor and Jesus said that they will always be with us. And TA, institute in the O of A a rank equivalent to a knighthood which does not carry a title. For example, "Commander". Two recipients might be Lee Kwan Yew, former Prime Minister of Singapore and the former PM of India. The relationship value should be considerable.</p>
