Kain Lawyers director appointed to Takeovers Panel

A public markets specialist at mid-tier firm Kain Lawyers has been appointed by the federal government to the Takeovers Panel for a three-year term.

Late last week, the Morrison government announced the reappointment of the president of the Takeovers Panel, Alex Cartel, as well as the reappointment of 12 members, all for a three-year term from 8 March 2022.

The federal government also announced the appointment of four new members: Alberto Colla, Timothy Longstaff, Deborah Page, and Kain Lawyers director James Burchnall.

The Takeovers Panel, the government said in a statement, provides a mechanism for peer review of takeovers activity, with the aim of being more efficient, less formal and more expeditious than the courts.

“These appointments will maintain the high level of skills and experience available to the panel, ensuring that it has appropriately qualified members to deal with the range of complex issues which are raised in applications,” the government said.

Mr Burchnall has been a director of Kain Lawyers – which has presences in Adelaide and Sydney – for almost seven years, prior to which he was a senior corporate lawyer at the firm. He has also served at Johnson Winter & Slattery and Herbert Smith Freehills.

He is based in Adelaide.

In a statement, the firm said that “James is an outstanding public markets lawyer”.

“His ability to apply a commercial lens to the technical complexities involved in M&A and ECM transactions is remarkable. He will be an incredible asset to the takeovers panel,” the firm noted.
