The Australian Lawyers Alliance (ALA) believes that the increasing numbers of workplace injuries in Tasmania are due to an erosion of common law rights.
ALA Tasmania president John Green believes that laws in the state - primarily that injured Tasmanian workers must record a whole person impairment of 20 per cent to be eligible to sue for lump-sum compensation - have taken away the rights of many injured Tasmanians to seek legal redress.
"The erosion of common law rights in this state means more people will continue to suffer when injured at work with no recognition for their pain and suffering, under a system that is constantly failing those it is supposed to protect and resulting in increasing numbers of people being injured," said Green.
Green added that a strong common law system should ensure that employers needed to be "vigilant" with regards to ensuring workplaces are free of hazards and contaminants.
