The Federal Court, however, has seen an increase in the number of court judgements delivered — they are up from 27 per cent in 2005 to 31.6 per cent in 2008. The NSW Supreme Court has meanwhile seen a decline, down from 45 per cent in 2005 to 42.4 per cent in 2008.
But even with this decline, the NSW Supreme Court still dominates in its share of the nation’s corporate law judgements — with the combined total of all judgements from other States not even coming close to what the court delivered over the last 12 months.
