This year the Commercial Law Association of Australia (CLA) celebrates the 15th anniversary of its June Judges lunchtime seminar series with two outstanding speakers.

The Hon Justice Anthony Payne from the Court of Appeal, Supreme Court of NSW, kicks off the series on 7 June covering ‘How does a corporation think?’. The seminar will cover principles of corporate attribution in proving a company’s intentions.’

He is followed on 21 June by the Hon Justice Ian Jackman from the Federal Court of Australia who takes a long look at ‘Cryptocurrency. A question of property’.

Cryptocurrency has now been recognised as a kind of property in various common law jurisdictions, although the issue has not yet arisen in substantive proceedings in Australia, and much of the reasoning and commentary as to the particular nature of the property is open to question. Justice Jackman’s seminar will examine that reasoning and will seek to demonstrate that longstanding High Court authority on the concept of ‘property’ should yield a clear answer in favour of the view that cryptocurrency is property, and as to the nature of that property.
