Macpherson Kelley client wins empowering victory
A dairy farmer client of Australian law firm Macpherson Kelley has won by unanimous decision in the Court of Appeals.
In a unanimous decision, Macpherson Kelley client Gary Harris achieved success upon appeal, which followed a 2020 decision that also ruled in his favour. Mr Harris, a dairy farmer, was originally granted titles promised to him by his father in the 2020 decision, which his father subsequently appealed.
“This was a comprehensive win (again) for our client, who has expressed his deep gratitude to the entire legal team. Gary really put his trust in us, and we’re so pleased to have been able to obtain this result for him,” she said.
“This was not only a legal and financial win but a result which will empower our client into the future.”
Macpherson Kelley represented Mr Harris for the second time during the inheritance case as his father contested the 2020 decision from the Supreme Court – which granted Mr Harris three and a half of the four titles promised to him. The remaining half of the fourth title was granted to Mr Harris’ brother, Craig Harris, a concession uncontested in Court.
During the original decision, the judge noted the detriment suffered by Mr Harris was “beyond the measure of money” and had altered the trajectory of his life in a way that now “could not be unscrambled”.
Though Mr Harris’ father lodged an appeal, the court ultimately ruled in Mr Harris’ favour, less than two weeks after the appeal hearing.
Mr Harris said that the care taken by Ms Goad and the Macpherson Kelley team was greatly appreciated during an uncertain and tumultuous time.
“We would like to thank Libby and her team for their work on our matter and the wonderful effort made to secure a positive outcome in the Court of Appeal,” he said.
“Libby has been amazing throughout this difficult and stressful time.”
