Victorian courts to ‘gradually adjust operations’

Victorian courts and the Victorian Civil and Administrative Tribunal (VCAT) have released a new update in response to restrictions easing in metropolitan Melbourne from Friday, 11 June.

Chief Justice of the Supreme Court of Victoria and chair of Courts Council Anne Ferguson has been keeping the profession up to speed with plans whilst the restrictions have been underway, with this latest one signalling that the Victorian courts and VCAT will be “gradually” adjusting operations.

This revised plan, Chief Justice Ferguson said, comes in response to the Victorian state government announcing further easing to restrictions in both metropolitan Melbourne and regional Victoria.

A mixture of in-person and remote hearings will continue in the courts, Chief Justice Ferguson declared.

Density limits will apply in court buildings other than spaces being used for jury trials, so remote hearings will play an ongoing and important role in continuing to hear matters.

Masks will be required to be worn in court buildings subject to exemptions.

Chief Justice Ferguson added new jury trials will resume in Melbourne from Friday, 11 June 2021. Trials that had to be vacated during the restrictions will be relisted as soon as possible, she flagged.

“We are grateful for the support provided by the legal profession and the agencies who contribute to our ongoing operations and the administration of justice for all Victorians,” Chief Justice Ferguson said.

“We acknowledge the way in which all those who work with and in the Courts and VCAT adapt so quickly to changing circumstances to ensure hearings can continue for the benefit of the Victorian community.”
