Legal watchdog pursues imposter

Victoria’s Legal Services Board has won a court battle against a lay person who has been found guilty of giving unqualified legal advice to tyre magnate Bob Jane.

Malcolm McClure attempted to provide legal advice to Mr Jane in 2011 and drafted court documents and legal correspondence for a Federal Court matter. This breached a consumer protection measure in the Legal Profession Act 2004, which prohibits non-lawyers from engaging in legal practice.

 
 

Mr McClure does not have any legal qualifications.

The county court, to which Mr McClure was appealing, upheld the decision of the Melbourne Magistrates’ Court in June 2014, finding him guilty of the charge.

He was sentenced to unpaid community work over two years and ordered to pay over $39,000 in costs for both the county court appeal and the original hearing.
