In the Federal Court action, the ACCC has alleged that Prepaid Services and Boost Tel have contravened the Trade Practices Act via deceptive advertising. Prepaid Services is a wholly owned subsidiary of Optus Mobile.
The ACCC said that the companies made representations that certain phone cards would provide consumers with a specified amount of call time and that no fees other than timed call charges would apply when that was not the case.
Injunctive relief, corrective advertising, community service orders and costs from the proceedings are being sought by the ACCC. The case comes before the court on 14 September 2009.
