Firms: King & Wood Mallesons (Medibank Health Solutions), Minter Ellison (Department of Defence)

Deal: Transformational outsourcing agreement with the Australian Defence Force (ADF) to provide high-quality health services to defence personnel across Australia

Area: Outsourcing

Value: $1.3 billion

Key players: Outsourcing specialist partner Patrick Gunning (pictured) led the KWM team, which also included partner John Topfer, who advised on medical malpractice issues, and partner Philip Ward, who advised on the insurance-related aspects of the deal. They were supported by senior associates Denisha Anbu, Kate Creighton-Selvay and Mandy Tsang

Deal significance: Under the deal, which will be effective from 1 July 2012, Medibank will manage and coordinate the ADF’s healthcare services nationally, to ensure care is effective, efficient and of a consistently high quality from point of injury or illness through to recovery. This new agreement will simplify and streamline the healthcare process for approximately 80,000 permanent and reserve ADF personnel and reinforce Medibank’s position as a leading provider of health services and solutions, in addition to health insurance. KWM advised Medibank on their response to ADF’s request for tender, which was issued mid last year and provided support to Medibank’s negotiation team after Medibank was selected as the preferred tenderer. The team also worked with Medibank to put in place a range of subcontracts for various aspects of the services, such as pathology, imaging and radiology, optometry and the provision of on-base health practitioners.
